FxTransit Terms of Service (TOS)

§1. General Rules

1. These Terms of Service (TOS) govern the use of services provided by FXTRANSIT. These services include, but are not limited to, colocation, VPS and dedicated servers.

2. By ordering a service, the Client fully agrees to these terms.

3. The Service Provider reserves the right to modify the TOS at any time without prior notice.

 

§2. AUP

1. Clients must use the services lawfully. Violations may result in service suspension.

2. Clients must provide accurate and truthful information when registering.

3. We offers unmanaged services and clients are expected to possess the necessary technical expertise to manage their services independently. By ordering a service, clients acknowledge that network quality may vary due to external factors beyond the service provider’s control.

4. Data of services is deleted immediately upon expiration unless renewed.

5. Please note that pricing may change without prior notice.

6. Unless otherwise specified, resources such as disk I/O, network ports, and CPU usage are shared among VPSs.

7. Clients are responsible for their usage and distributed content.

8. Public proxies, spam, hacking activities such as scanning and DDoS attacks, and other malicious activity are strictly prohibited and will result in termination without refund.

 

§3. Payments

1. Currently, payments are only accepted via Alipay.

2. All payments are non-refundable under any circumstances.

3. Affiliate earnings can only be withdrawn via USDT, and commissions are activated after 90 days of a referred successful payment.

 

§4. Liability

1. The Service Provider shall not be held liable for any service disruptions or damages caused by issues with upstream network providers, including transit carriers, data center backbone failures, or peering disruptions. This also applies to failures caused by force majeure events, such as natural disasters, government actions, war, or pandemics.

3. For shared-resource services such as VPS hosting, the service provider does not guarantee network connectivity speeds to specific regions or countries. This includes, but is not limited to, mainland China.

4. Under no circumstances shall the Service Provider’s liability exceed 50% of the monthly fee for the affected service. This applies only in cases where the Service Provider is directly at fault.

 

§5. Complaint

1. Clients may submit complaints via ticket.

2. Complaints must include the necessary details to address the problem. For example, when reporting network issues, MTR and iperf3 are needed for both directions on a server with sysctl.conf untouched.
